Hunan Provincial Department of Science and Technology: On the Examination and Approval of Foreigner's Work Permit in Hunan During the Epidemic Period of COVID-19

Application procedures of foreigners¡¯ work permit are carried out by means of ¡°Notification + Commitment¡± online. Examination and approval of the work permit will all be based on the application materials submitted online and the rest of the procedures remain the same as those to be followed on the site.

I Application for Foreigners¡¯ Work Permits

(1) The approval process for foreigners¡¯ work permit should be done online. A commitment letter on online application for foreigners¡¯ work permit (as annexed at the end of this passage) should be unloaded in the ¡°other annexes¡± column of the online application system. The employers can print related files after the application is approved.

(2) The foreigners who have obtained work permits but have not yet entered China, are strongly advised to apply for Z visa at the Chinese embassies and consulates in their countries, and plan their trips to China after getting the visas during the valid period.

(3) The foreigners who have obtained work permits, but cancelled their work plan in China, could ask their employers to apply online for cancelling their work permits.

(4) The process of the application for work permits after foreigners¡¯ arrival in China remains unchanged. The employer representatives should wear masks and make good personal protection when they go to handle the application process.  


II Application for Employment Transfer, Extension, Change, and Cancelling of Foreigners¡¯ Work Permits 

During a Level One public health emergency response  period, the employers should handle all foreigners¡¯ work permit affairs online, including employment transfer, extension, change, and cancelling. Details are as followed:

The employers need not to submit the original copy of the application documents to the service centers. They can upload the commitment letters on online application for foreigners¡¯ work permit (as annexed at the end of this passage) in the ¡°other annexes¡± column of the online application system, to ensure the authenticity of all the submitted materials.

The applicants need not to submit their foreigners¡¯ work permits by post when they apply for employment transfer, extension, and change.

III Application for Work Permit or Visa Extension Between January 31, 2020 and February 2, 2020

The foreigners whose work permits expire during this period could apply for extension. They can apply for urgent service via calling 0731-88988067.

IV Providing Employment Termination by E-documents

During the epidemic period, when the employers and foreign employees agree to terminate the labor contracts, while the foreign employees cannot sign the certificate of dissolution, the documents such as relative email loop, discussion record via WeChat, or the certificate of dissolution with electronic signature, can be recognized. Explanations can be added with the e-documents. The employers could apply for cancelling the foreign employees¡¯ work permits online.

1. Temporary Suspension of Entry by Foreign Nationals

In view of the rapid spread of COVID-19 across the world, China has decided to temporarily suspend the entry into China by foreign nationals holding visas or residence permits still valid to the time of this announcement, effective from 0 am, March 28, 2020. Entry by foreign nationals with APEC Business Travel Cards will be suspended as well. Policies including port visas, 24/72/144-hour visa-free transit policy, Hainan 30-day visa-free policy, 15-day visa-free policy specified for foreign cruise-group-tour through Shanghai Port, Guangdong 144-hour visa-free policy specified for foreign tour groups from Hong Kong or Macao SAR, and Guangxi 15-day visa-free policy specified for foreign tour groups of ASEAN countries will also be temporarily suspended. Entry with diplomatic, service, courtesy or C visas will not be affected. Foreign nationals coming to China for necessary economic, trade, scientific or technological activities or out of emergency humanitarian needs may apply for visas at Chinese embassies or consulates. Entry by foreign nationals with visas issued after this announcement will not be affected. 

The suspension is a temporary measure that China is compelled to take in light of the outbreak situation and the practices of other countries. China will stay in close touch with all sides and properly handle personnel exchanges with the rest of the world under the special circumstances. The above-mentioned measures will be calibrated in light of the evolving situation and announced accordingly.

2. China to Reopen Entry by Foreign Nationals Holding Three Categories of Valid Chinese Residence Permits

China announced on Sept 23 that it will reopen entry by foreign nationals holding three categories of valid Chinese residence permits.

The announcement was jointly made by the Ministry of Foreign Affairs and the National Immigration Administration.

In view of the current COVID-19 situation and the need of epidemic prevention and control, adjustments are now made to the Announcement by the Ministry of Foreign Affairs and the National Immigration Administration on the Temporary Suspension of Entry by Foreign Nationals Holding Valid Chinese Visas or Residence Permits issued on March 26, 2020, according to the announcement on Sept 23.

Starting 0:00 am, Sept 28, 2020, foreign nationals holding valid Chinese residence permits for work, personal matters and reunion are allowed to enter China with no need for applying for new visas, it said.

Holders of the above three categories of residence permits, which expired after 0:00 am, March 28, may apply for relevant visas by presenting the expired residence permits and relevant materials to the Chinese embassies or consulates on the condition that the purpose of the holders' visit to China remains unchanged, according to the announcement on Sept 23.

The above-mentioned personnel shall strictly abide by the Chinese regulations on epidemic prevention and control.

Other measures in the announcement issued in March will continue to apply.

The Chinese government will continue resuming people-to-people exchanges in a step-by-step and orderly manner while ensuring effective epidemic control, per the announcement on Sept 23.
